Pune, 6th November 2026: If your housing society in Kothrud, Erandwane or Aundh is talking about redevelopment, the rules have changed. Maharashtra issued a new order on the redevelopment of co-operative housing societies on September 30, 2026, replacing the government resolution of July 4, 2019 in many respects.

At a seminar in Kothrud, Maharashtra State Co-operative Housing Societies Federation president Suhas Patwardhan said the order would bring more transparency, clearer tender procedures and defined timelines, as reported by Punekar News.

What stays the same

The consent rules have not been relaxed. Approval from at least 51% of the total membership is still needed, and the two-thirds quorum for Special General Meetings (SGMs) remains.

What is new or changed

  • The number of SGMs before appointing a developer goes up from two to four.
  • Tenders must be advertised in newspapers in both Marathi and English.
  • Tenders are to be opened at a Special General Meeting.
  • The project report must compare the applicable DCPR and UDCPR schemes.
  • A Registrar’s representative must be present at developer selection, with identity checks of members.
  • A secret ballot can be held if the required number of members ask for one.
  • Office-bearers who break the order or act against members’ interests can be held accountable.

A provision-by-provision comparison presented by CA S Lakshminarayanan of Dreams Redeveloped found that of 84 provisions, 38 were unchanged, 24 modified, 17 entirely new and 5 from the 2019 resolution not restated.

Grey areas

How the order applies to redevelopment projects already underway is not fully clear, and some stages still have no fixed timelines. Societies midway through the process should take legal advice before the next meeting.

A checklist for society members

Ask the committee for the project management consultant’s report, check that the SGM notices follow the new sequence, insist on the newspaper tender, and keep copies of every resolution. If the developer is new to you, check their past projects on MahaRERA using our MahaRERA guide, and understand stamp duty on redevelopment agreements.

This is general information, not legal advice. Societies should consult a lawyer or the Registrar’s office for their specific case.
