In Pune, a rent agreement is registered as a leave and licence agreement, and you can do it fully online through the IGR Maharashtra e-registration service. Stamp duty is 0.25% of the total rent for the period plus notional interest on the deposit, and the registration fee is Rs 1,000 in municipal areas such as PMC and PCMC. Registration is compulsory under the Maharashtra Rent Control Act.

Pune has one of the busiest rental markets in Maharashtra, from students in Kothrud and Viman Nagar to IT staff in Hinjewadi, Kharadi and Wakad. Most of these deals run on 11-month leave and licence agreements. Many people still get them done through an agent, but the same online system is open to owners and tenants directly.

Is registering a rent agreement compulsory in Maharashtra?

Yes. Section 55 of the Maharashtra Rent Control Act, 1999 says every agreement for leave and licence or tenancy must be in writing and registered, whatever the period. The responsibility to register lies with the landlord (licensor). If the agreement is not registered and a dispute reaches court, the tenant’s version of the terms is presumed correct unless the landlord proves otherwise. The Act also provides for a fine and imprisonment of up to three months for a landlord who fails to register.

A notarised agreement on stamp paper is not the same as a registered agreement. For a rental in Maharashtra, notarisation alone does not meet the legal requirement.

Stamp duty and fees for a rent agreement in Pune

Stamp duty on a leave and licence agreement is charged at 0.25% of the total amount for the agreement period, which includes the total rent, any non-refundable deposit or advance, and interest on the refundable deposit calculated at 10% a year. The IGR website has a calculator that works this out for you.

ChargeAmount (Pune city, PMC or PCMC area)
Stamp duty0.25% of (total rent + non-refundable amounts + 10% a year notional interest on refundable deposit)
Registration feeRs 1,000 (Rs 500 in rural areas)
Document handling chargeAround Rs 300, shown at the time of payment
Agent or service feeNot a government charge. Only if you use an agent or doorstep service

Worked example: an 11-month agreement in Baner at Rs 20,000 a month with a Rs 1,00,000 refundable deposit. Total rent is Rs 2,20,000. Notional interest on the deposit is 10% a year for 11 months, about Rs 9,167. Stamp duty at 0.25% of Rs 2,29,167 comes to about Rs 573, which the calculator rounds as per the rules. Add the Rs 1,000 registration fee and the handling charge, and the total government cost is roughly Rs 1,900. Use the official calculator for the exact figure, as rounding and minimum duty rules apply.

Unless the agreement says otherwise, the tenant usually pays these charges. That is a custom, not a rule, so agree on it before you start.

Steps to register a rent agreement online

  1. Open the IGR Maharashtra website, igrmaharashtra.gov.in, and choose the online leave and licence (e-registration) service under online services.
  2. Select the district (Pune), set a password and note the token number the system gives you.
  3. Enter property details: address, CTS or survey number, flat or house number, area and type of use.
  4. Enter details of the owner (licensor), the tenant (licensee) and two witnesses, with their Aadhaar numbers.
  5. Fill in the rent, deposit, period, start date and other terms, then review the draft agreement.
  6. Pay the stamp duty and registration fee online through GRAS, the state’s payment gateway.
  7. Complete Aadhaar-based identification and the biometric step for each party. This needs a fingerprint scanner and webcam, which is why many people use an authorised service provider for this step.
  8. Submit. The agreement goes to the Sub-Registrar’s office for approval, and the registered copy can be downloaded as a PDF once approved.

All parties do not need to be in the same place. Each one can complete their identification step separately, which helps when the owner lives outside Pune or abroad.

Doing it yourself or through a provider? The government charges are the same either way. Authorised service providers charge extra for drafting and bringing a biometric device to your home. If you have a compatible device and all parties have Aadhaar linked to a working mobile number, you can do it yourself.

Documents you will need

  • Aadhaar card of the owner, tenant and both witnesses (Aadhaar linked to an active mobile number helps with OTP)
  • PAN card of the owner and tenant
  • Proof of ownership for the property, such as the latest property tax receipt, Index II or the sale deed
  • Passport-size photographs, if the provider asks for them
  • Society NOC, if your housing society requires one

If you are not sure which records prove ownership, our guides on downloading a property card online and paying PMC property tax explain where to find them.

Tenant police verification in Pune

Registering the agreement and informing the police are two separate steps. Pune City Police and Pimpri Chinchwad Police require landlords to give tenant details to the police, and an owner who skips it can face action. You can submit the tenant information form at the local police station or through the police’s online citizen services; Pune Rural Police has its own online tenant information form. Keep a copy of the acknowledgement with the agreement.

Common mistakes

  • Signing only a notarised agreement and skipping registration.
  • Entering the wrong deposit amount, which changes the stamp duty and the legal record.
  • Forgetting to register a fresh agreement when the 11-month term ends and you renew.
  • Leaving police verification for later. Do it when the tenant moves in.
  • Paying for stamp duty through an unofficial link. Pay only through GRAS or the IGR portal.
