MahaRERA Orders Gera Developments To Pay Interest To Wagholi Flat Buyers For Delayed Possession; Rejects Force Majeure Plea

MahaRERA has ruled that the PMRDA-to-PMC jurisdiction change did not excuse a delay at Gera’s Planet of Joy project in Wagholi, and ordered interest for buyers.

Pune, 29th October 2026: MahaRERA has ordered Gera Developments to pay interest to four flat buyers in Wagholi for handing over their homes late. Anyone who has bought in Pune’s fast-growing eastern suburbs will want to read this one.

The buyers had booked flats in buildings H1 and H2 of Planet of Joy Project III (MahaRERA No. P52100031875). Their agreements promised possession by December 31, 2025.

The timeline

The developer applied for the occupation certificate on January 14, 2026, after the deadline had already passed. The notice moving the area’s planning jurisdiction from PMRDA to the Pune Municipal Corporation came on February 11. The OC was finally issued on May 29, and possession letters went out on June 22.

MahaRERA has ordered interest at SBI’s MCLR plus 2%, payable from January 1, 2026, until a valid offer of possession.

The developer’s arguments

Gera argued that the delay was force majeure, pointing to the transfer of planning powers from PMRDA to PMC. MahaRERA member Mahesh Pathak didn’t accept that. The order says an administrative change does not automatically excuse a developer from its obligations, and that no documents were produced showing what the obstacle actually was, how long it lasted or how it held up the OC.

The developer also said some buyers had paid instalments late. MahaRERA said that didn’t rule out interest, since there was nothing to show those late payments caused the delay. Both sides can still claim interest on any overdue amounts owed to them.

What the buyers didn’t get

Their separate compensation claims were turned down because they chose to stay in the project and take possession. Their requests for possession or a refund also became irrelevant once possession was offered. Their right to interest for the delay, however, stands.

For other homebuyers

Many projects in Wagholi, Kharadi and nearby areas got caught up in the shift of planning powers to the PMC. This order makes it clear that the transfer, on its own, isn’t a reason to avoid paying delay interest. If your project has gone past its promised date, keep your agreement, payment receipts and all correspondence with the developer in one place before approaching MahaRERA.
